Can you believe this was the scene outside an insurance agency with employees' cars parked during the daily business hours??? Immediately after it happened everyone asked "who pays?". Since the tree was full of leaves and had NO sign of disease or damage, the following applied:
A tree owner may be held liable for injuries caused by the defective
condition of a tree only if the tree owner has actual or
constructive knowledge of the tree’s defective condition. In other
words, if the tree owner had knowledge the tree was rotten, dead, or had any
other condition that created a risk that the tree could fall the tree owner could be held liable.
